Employment & Labour Law
Our Employment & Labour Law Group provides legal advice and representation to clients in both unionized and non-unionized work environments, and participates in the negotiation and drafting of collective agreements. The members of this group actively engage in all of the steps of the labour dispute resolution process including negotiation, arbitration, conciliation and mediation, and appear regularly before administrative tribunals such as the Manitoba Labour Board, the Canada Labour Relations Board, the Manitoba Workers' Compensation Board, as well as in matters of labour litigation before the courts at all levels.
With respect to unionized workplaces, lawyers in our labour group have particular expertise relating to labour issues within the health care field. Our lawyers give advice and opinions in all labour matters. Additionally, we offer a number of services to all of our clients in unionized workplaces, including:
- advice regarding the interpretation and application of governing collective agreements;
- collective bargaining;
- advice regarding dismissals, suspensions, and other matters governed by a collective agreement;
- negotiation of settlements;
- advice regarding unfair labour practice applications;
- representation before arbitrations boards, the Manitoba Labour Relations Board;
and other administrative tribunals;
- preparation and representation of applications for judicial review before Manitoba Court of Queen's Bench.
- educational seminars regarding topics that are of immediate or future concern to unionized workplaces.
With respect to the non-unionized workplaces, we provide advice and representation on employment law and regulations to both employers and employees, our services including:
- advice regarding employment contracts;
- advice regarding employee discipline and termination;
- employment rights and benefits
- negotiation of severance packages with respect to dismissed employees;
- conduct of legal actions and trials at the Manitoba Court of Queen's Bench's Level;
- representation of clients at adjudications governed by the Canada Labour Code;
- adjudication of claims governed by Canada Labour Code;
- human rights and equity issues (including Charter litigation)
- sexual harassment
- accommodation of disabilities
- workplace safety and health and occupational safety matters, and all governmental agencies and departments involved with human resources concerns.
